TERMS OF SERVICE

These Terms of Service for Members (“Terms”) are a binding legal agreement between  you and Transforming Relationships that govern your use of the websites, applications, and other offerings from Transforming Relationships (collectively, the “Transforming Relationships Platform”). When used in these Terms, “Transforming Relationships,” “we,” “us,” or “our” refers to the Transforming Relationships entity with whom you are contracting.

 

The Transforming Relationships Platform is an online academy offering an online platform that enables members (“Members”) to engage in educational programs, online chat, access additional training material. To register and set up an educational account to access and use the features of the Transforming Relationships Platform you must pay a nonrefundable fee as specified in the Payments Terms of Service (“Payment Terms”). Transforming Relationships is not a therapeutic entity and is not subject to any acts of parliament regarding psychotherapeutic services. Transforming Relationships does not offer counseling or therapeutic modality.

 

We maintain other terms and policies that supplement these Terms like our Non-Disclosure Policy which describes our intellectual property, our  Privacy Policy, which describes our collection and use of personal data, and our Payments Terms, which govern any payment services provided to Members by the Transforming Relationships payment entities ("Transforming Relationships Payments").

1.      Enrollments

When you enroll in TR, you are agreeing to pay all charges for your enrollment including all applicable fees like Transforming Relationships’s service fee, fees, and any other items identified during checkout (collectively, “Total Price”). When     you receive the Enrolling confirmation, you will be sent your online login information which you can use to access the Transforming Relationship Academy through its online portal. The cancellation policy and any other rules, standards, policies, or requirements identified are set out below.

1.1.     All enrollments for Transforming Relationships Academy personal development program(s) and self-paced learning must be made via the Transforming Relationships Academy website.

1.2.     Booking/registration Confirmation

1.2.1.   All enrollments  will be confirmed via email to the booking contact that was listed on the booking form. Please retain a copy of your registration email for your records. This email will be a Tax Invoice for GST when you make payment.

1.2.2.    If an enrollment confirmation (and tax invoice) is not received by TR contact within 2 business days, please contact Transforming Relationships via email TRProgram@transformingrelationships.com

1.3.     Access to Transforming Relationships Online Academy

1.3.1.   Participants who register for TR modules will have access to the modules for up to six months from the date of registration.

1.3.2.   At the six month mark, digital access will expire, and participants will need to re-register for the self-paced modules should they wish to complete them again.

2.      Fees & Payment

Except as otherwise provided on the Transforming Relationships Platform, all fees are non-refundable. The full course fee is payable must be made before enrolment in order to receive your login registration information to access the Transforming Relationships Online Program. Access will not be granted until payment has been received in full.  Transforming Relationships reserves the right to change the service fees at any time, and will provide Members notice of any fee changes before they become effective. Fee changes will not affect enrollments made before the effective date of the fee change.

2.1.     The full course fee is payable before enrolment. 

2.2.     Payment must be made to receive your login registration information to access the Transforming Relationships Online Program. Access will not be granted until payment has been received in full.

2.3.     Full payment is required regardless of attendance (refer to Cancellation and Refund).

2.4.     Promotional codes may only be redeemed once per person during the relevant promotional period to provide a course fee discount. The total amount of all applicable discounts may not exceed 25% of the course fee. You must tell us before payment if you are eligible for any discounts.

2.5.     If paying by electronic funds transfer (EFT), payment terms are 14 days and MUST be received before the event. If you wish to pay by an alternative method or have any questions, please contact Transforming Relationships via email at trprogram@transformingrelationships.com.au

2.6.   We are required to apply the Goods and Services Tax (GST) on all courses not defined as an ‘educational course’ in the Goods and Services Tax Act 1998. All liable courses include the GST in the advertised fee.

2.7.   You agree that all funds are non-refundable and further agree to complete all courses, in their entirety, within six months from the date of payment. 

3.      Cancellation and Refund

In general, if you cancel a reservation, no refunds will be made if you withdraw within 14 days before the program start or if you decide to change your mind after attending the program.  But, in certain situations, If something outside your control required you to cancel a reservation, you may transfer your enrollment to alternative participants or undertake the program at an alternative date (see Extenuating Circumstances Policy).

3.1.     No refunds will be made to participants who withdraw within 14 days before the session or if the participant decides to change their mind after attending the program, or fails to attend the session however an alternative participant name may be submitted (see 4 - Transfers).

3.2.     Extenuating circumstances: If you believe there are extenuating circumstances that warrant special consideration to cancel your course booking you must request in writing to Transforming Relationships via email trprogram@transformingrelationships.com.au no less than 14 days before the course start date. The application must be made in writing and accompanied by relevant documentation (e.g. medical certificate). An application for special consideration does not guarantee acceptance and each application will be considered on its merits by TR. If the application is successful, TR will offer a course transfer to another date of the same value or refund the fee, less than 20% to cover any administration costs. Refunds will only be credited to the original funding source or via other means as agreed by TR., they may apply to TR for a refund.

3.3.     You agree to pay an additional $25.00 fee to TR for handling each returned payment and shall reimburse TR for any fees charged by TR’s bank related to the returned check.

3.4.     We may change the course details or cancel any course including those with insufficient enrolments or because of circumstances beyond our reasonable control. Alternative dates or a refund will be offered to you in these circumstances. If TR needs to cancel, relocate, or defer a session, the booking contact and participants will be contacted by email and phone.  A transfer to another date or a full refund will be offered to the participants.

4.      Transfers

4.1.     If you are unable to attend the Transforming Relationship Program you are enrolled in, another person may attend the course in your place for the entire course at no extra charge, provided that:

4.1.1.   you let us know in writing before the course starts; and

4.1.2.   you and that person respectively agree to all terms and conditions which may apply in this case.

5.      Intellectual Property

Transforming Relationships takes a meta psychotherapeutic approach. Using a depth psychological lens to understand relationships we draw from theoretical perspectives of some of the greatest writers and philosophers of our time. Our approach is comprehensive, multifaceted, and systemic. 

It is designed to experientially enable our participants to understand how social-cultural and family relationships shape our personal and interpersonal lives. Using new developments in psychology to link mind/body integration with concepts of power to better integrate meanings we give to social and personal events.

5.1.     Unless otherwise indicated, TR owns the copyright for the content presented through the personal development program, events, and self-paced modules. Some of the content copyright may be owned by individual presenters and has been made available under a license or agreement.

5.2.     The content must under no circumstances be reproduced, stored in a retrieval system, or transmitted in any form or by any means electronic, mechanical photocopying, recording, or otherwise, without the permission of the author.

5.3.     Personal  development sessions and recordings are to be viewed by the registrant only;

5.4.     The Transforming Relationships program and self-paced modules provide reference materials for your use during or after the professional development session. These may include (but are not limited to) the following: a copy of the slides, sample documents, templates, or other material for use during the professional development, responses to questions

5.5.     All materials made available remain the copyright of the Transforming Relationships. They must not be distributed to any third party at any time or in any form without written permission from the TR.

5.6.     Personal development materials and the subject and information contained in the materials and learning module are advisory in nature and do not constitute formal, professional, or therapeutic advice.

5.7.     Any breach of copyright, including recording the personal development program or any unauthorized use of the material may lead to legal action.

5.8.     All inquiries seeking permission to reproduce any part of this <paper and/or learning module> should be addressed to the author. In the first instance, it is suggested that this be done via the TR.

6.      Transforming Relationships Code of Conduct - Ground Rules

The Transforming Relationship program attracts a wide diversity of people coming from different social, cultural, political, backgrounds, life experiences, sexual orientations, as well as sexual and gender expressions.  The TR program is experiential, involving group discussions with divergent experiences, opinions  We aim to create a supportive and accepting environment to enhance everyone’s experience.  As such we ask you to be cognizant of the following terms:

We offer a platform that enables Members to connect, exchange ideas, chat as they explore, and reflect on the contents. When Members enroll, they are entering into a contract directly with other members in their group. We work hard to ensure our Members have great experiences using Transforming Relationships, we do not and cannot control the conduct of our members.

We ask you to follow these basic collegiate ground rules.

6.1.     For us to begin on time for each session, we would appreciate you coming into the session 5 minutes early. 

6.1.1.   notify us if you are going to be absent or late for a class so we do not wait for you. 

6.2.     We expect each person to 

6.2.1.   Determine the level of disclosure they feel comfortable with. 

6.2.2.   Takes responsibility for their emotions.

6.2.3.   Respect, affirm, and explore differences.

6.3.     We appreciate all Members building and enhancing respectful connection by doing the following;

6.3.1.   Put your videos on especially in small group discussions.

6.3.2.   Keep what is said or shared in the group discussions private confidential.  What is said in the program stays in the program.

6.3.3.     Do not copy or share this copyrighted material.

6.4     You acknowledge that Transforming Relationships has no general obligation to monitor the use of the Transforming Relationships Platform and verify information provided by our Members, but has the right to review, disable access to, remove, or edit Content to: (i) operate a safe accepting culture and secure and improve the Transforming Relationships Platform (including for fraud prevention, risk assessment, investigation and customer support purposes); (ii) ensure Members’ compliance with these Terms; (iii) address Member Content that we determine is harmful or objectionable; (iv) take actions set out in these Terms; and (v) maintain and enforce any quality or eligibility criteria, including by removing Members who do not comply with Transforming Relationships Code of Conduct.

7.      Member Responsibilities

7.1.     You must register an account to access the online features of the Transforming Relationships Platform. Enrollment is only permitted for legal entities, partnerships, and persons who are 18 years or older.

7.2.     Once you are enrolled, the Transforming Relationship portal will request you change your password. You must provide accurate, current, and complete information during registration and keep your account information up-to-date. You may not register more than one account or transfer your account to someone else.

7.3.     You are responsible for maintaining the confidentiality and security of your account credentials and may not disclose your credentials to any third party. You must immediately notify Transforming Relationships if you suspect that your credentials have been lost, stolen, or your account is otherwise compromised.

7.4.     You are responsible and liable for activities conducted through your Transforming Relationships Account unless such activities are not authorized by you and you are not otherwise negligent (such as failing to report the unauthorized use or loss of your credentials).

7.5.     Members agree to cooperate with and assist Transforming Relationships in good faith and to provide Transforming Relationships with such information and take such actions as may be reasonably requested by Transforming Relationships concerning any investigation undertaken by Transforming Relationships regarding the use or abuse of the Transforming Relationships Platform.

8.      Continuous Improvement

8.1.     At Transforming Relationships we are committed to continuous improvement in delivering excellent content and service to Members.  As such we have implemented a formal feedback process per class.

8.2.     After each class, Members will have an opportunity to review and provide feedback. Your  Review must be authentic and may not contain any discriminatory, offensive, defamatory, or other language that violates our Content Policy or Feedback Policy.

8.3.     Parts of the Transforming Relationships Platform are designed to enable you to provide feedback, text, photos, audio, video, information, and other content (“Content”) to other members of your group. Content must comply with and be non-discriminatory, not obscene, harassing, deceptive, or violent.

8.4.     Where we remove or disable Content, we will notify a Member and provide the reasons for such a measure, unless such notification would (i) prevent or impede the detection or prevention of fraud or other illegal activities, (ii) harm the legitimate interests of other Members, or (iii) contravene applicable laws. You may appeal such a decision by contacting TR via email.

8.5.     By providing Content, in whatever form and through whatever means, you grant Transforming Relationships the right to access, use, store, copy, modify, publish, transmit, stream, broadcast, and otherwise use in any manner such Content to provide and/or promote the Transforming Relationships Platform, in any media or platform, known or unknown to date and in particular on the Internet and social networks. If Content includes personal information, such Content will only be used for these purposes if such use complies with applicable data protection laws in accordance with our  Privacy Policy.

9.      Member Responsibilities

10.5.     By providing Content, in whatever form and through whatever means, you grant Transforming Relationships the right to access, use, store, copy, modify, publish, transmit, stream, broadcast, and otherwise use in any manner such Content to provide and/or promote the Transforming Relationships Platform, in any media or platform, known or unknown to date and in particular on the Internet and social networks. If Content includes personal information, such Content will only be used for these purposes if such use complies with applicable data protection laws in accordance with our  Privacy Policy.

11.    General

11.    Our privacy policy outlines information relating to the collection and handling of your personal information by us. A copy of the policy is available on our website and to you on request.

11.1.  TR utilizes various digital and electronic technologies in its business and related operations.  These technologies may include but are not limited to e-mail, cell phone (smartphone), secured and unsecured Wi-Fi networks, Bluetooth, Zoom, Viber, etc.  Members give TR permission to utilize these and other commonly used technologies and acknowledge that confidentiality is assured by TR only when utilizing The Transforming Relationships  Academy which is accessible through the Applicant portal.

11.2.  Members acknowledge that Transforming Relationships is not able to ensure confidentiality when using standard or free e-mail systems and/or software (i.e. Skype, Gmail, etc.).

11.3.  The applicant gives TR permission to contact him/her only for the purposes of scheduling or non-confidential administrative matters using these technologies and when The Transforming RelationshipsTM Academy or other means are not accessible due to technical outages and/or malfunctions.

11.4.  When you enroll, we collect your first and last name, preferred email address, contact details, and geo-location.

11.5.  We encourage you to be as authentic as you wish in what information you share including what name you wish to be known as, your relationship, or sexual orientation on the Transforming Relationships online academy portal.

11.6.  You can make certain information publicly visible to others, such as Your public profile page, which includes your profile photo, first name (or how you want to be known where applicable), description, and city. profile photo, additional information you choose to share, and content in a community or discussion forum, blog, or social media post.

11.7.  We use this information for administrative purposes, to register you, and to process payments. We will also use this information to provide you with promotional messages, marketing, advertising, social media, and referral programs.

11.8.  Where you provide consent, we will share your information as described at the time of consent, such as when authorizing a third-party application for our education portal.

11.9.  Where permissible under applicable law, we may use certain information that you give us de-identify it and share it with social media platforms to generate leads, drive traffic to Transforming Relationships, or otherwise promote our products and services.

11.10.        Nothing in these terms and conditions will affect your statutory rights, and nothing in these terms and conditions will limit or exclude our liability for death or personal injury arising through negligence, fraudulent misrepresentation, or anything else that cannot be excluded or limited by us by law.

12.    Complaint handling and Mediation

12.1       Complaints Handling and Mediation: We want to be transparent about how we handle complaints and aim to treat all Business Users fairly. We seem continuous improvement feedback on our program.  You can also contact us via email regarding complaints. 

12.2.        Transforming Relationships is committed to participating in a consumer-friendly dispute resolution process. To that end, we provide a two-part process for individuals: (1) an informal negotiation directly with Transforming Relationships’s customer service team, and if necessary (2) a binding arbitration administered by the Victorian Small Business Commission (“VSBC”). You and Transforming Relationships each retain the right to seek relief in small claims court as an alternative to arbitration.

13.    Dispute Resolution and Arbitration Agreement.

13.1.        As a consumer you can access the Victorian Small Business commission online dispute resolution platform here: https://www.vsbc.vic.gov.au/dispute-resolution/mediation-process/ Please note that Transforming Relationships is not committed nor obliged to use an alternative dispute resolution entity to resolve disputes with consumers.

13.2.        This Arbitration Agreement only applies to you if your country of residence or establishment is in Australia. If your country of residence or establishment is not Australia, and you nevertheless attempt to bring any legal claim against Transforming Relationships, this Arbitration Agreement will apply for determination of the threshold issue applies to you, and all other threshold determinations, including residency, arbitrability, venue, and applicable law.

14.    Liability: To the extent permitted by law, we are not liable for any indirect, special, incidental, or consequential damages or otherwise (including without limitation loss of income or revenue, loss of business, loss of profits or contracts, loss of opportunity, loss of anticipated savings, loss of data, loss of goodwill), however arising and whether caused by tort, breach of contract or otherwise, even if we have been advised of the possibility of such damages.

15.    indemnification clause: Applicant shall defend, indemnify and hold harmless TR and its directors, officers, employees, agents, affiliates, Applicants and customers (collectively, “Indemnified Parties”) from and against all allegations, claims, actions, suits, demands, damages, liabilities, obligations, losses, settlements, judgments, costs and expenses (including without limitation attorneys’ fees and costs) which arise out of, relate to or result from any act or omission of Applicant.

16.    Attorney Fees: Should any party employ an attorney or attorneys to enforce any of the provisions hereof or to protect its interest in any manner arising under this Agreement, or to recover damages for breach of this Agreement, the non-prevailing party in any action pursued in a court of competent jurisdiction (the finality of which is not legally contested) agrees to pay to the prevailing party all reasonable costs, including but not limited to damages and expenses, including attorney's fees, expended or incurred in connection therewith.

16.1 A party that voluntarily dismisses an action or proceeding shall be considered a non-prevailing party for purposes of this provision.

15.2. Attorney’s fees incurred in enforcing any judgment regarding this Agreement are recoverable as a separate item. The preceding sentence is intended to be severable from the other provisions of this Agreement and to survive any such judgment.

17.    Choice Of Law: Jurisdiction: This contract shall be governed by, construed, and enforced in accordance with the laws of the State of Victoria, without giving effect to conflict of laws and principles.  Any dispute involving the terms or conditions of this contract shall be brought in the court of competent jurisdiction of Melbourne, Victoria.  Each of the parties hereby submits to the personal jurisdiction of said court.
